ALL USERS OF THE IGP WEB SITE, "CONSILIENCE: THE BLOG" SITE, AND IGP MEMBERS PLEASE READ THIS AGREEMENT CAREFULLY. 

WHERE THIS DOCUMENT REFERS TO THE "INSTITUTE OF GREEN PROFESSIONALS" AND "MEMBERS," IT ALSO APPLIES TO THE "CONSILIENCE: THE BLOG" AND ITS MEMBER SUBSCRIBERS.  WHERE THE "IGP SITE" IS REFERENCED, IT INCLUDES "CONSILIENCE: THE BLOG."  "CONSILIENCE: THE BLOG" IS LOCATED ON A SUBDOMAIN OF WWW.INSTITUTEOFGREENPROFESSIONALS.ORG.

BY ACCESSING THE IGP WEB SITE, "CONSILIENCE: THE BLOG" SITE, BECOMING AN ASSOCIATE OF IGP OR A MEMBER, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS. YOU SHOULD PRINT AND RETAIN A COPY OF THESE TERMS AND CONDITIONS.

IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU SHOULD NOT APPLY FOR MEMBERSHIP OR ACCESS OR USE THE IGP WEB SITE AND/OR THE "CONSILIENCE BLOG" SITE.

THE INSTITUTE OF GREEN PROFESSIONALS DISCLAIMS ALL WARRANTIES WITH REGARD TO THE INFORMATION CONTAINED IN ITS WEB SITES, INCLUDING ALL IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS AND NONINFRINGEMENT. IN NO EVENT SHALL THE INSTITUTE OF GREEN PROFESSIONALS (INCLUDING THE CONSILIENCE BLOG) BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THIS INFORMATION.

Refund and Cancellation Policy
 
There are no refunds on any payments to the Institute of Green Professionals for any reason, including Membership cancellation. 
 
Privacy Policy

The Institute of Green Professionals has created this privacy policy in order to demonstrate our commitment to the privacy of our membership and web site users.

Use of Member Personal Information

Personal information will be required of IGP Associates, Members and "Consilience: The Blog" Members for a variety of reasons such as:

  1. Control access to restricted member areas of the web site.
  2. Process payments or applications submitted by you.
  3. Verify your identity (e.g., confirmation of your membership).
  4. Carry out member administrative functions.
  5. Send you membership and services news.
  6. Administer member professional conduct issues.

The terms and conditions of the use of personal information of an Associate and/or Member by IGP are as follows:

  1. By using the IGP Site you agree to provide certain personal information.
  2. You agree that all data provided by you is accurate.
  3. You agree that in the Associate or Member registration process you will not misrepresent your identity, status or any other information provided.
  4. You agree to inform IGP of any changes to the information you provided to IGP in a timely manner.
  5. You agree to keep your Associate/Member password confidential at all times and will not disclose it to anyone else or permit anyone else to use it.
  6. IGP reserves the right to change, or require you to change, your password at any time in its sole discretion.
  7. IGP reserves the right to disable your password at any time, if in the opinion of IGP, you have failed to comply with any of these terms and conditions.
  8. You will not use the IGP site for any activity that is inconsistent with your obligations in the IGP Code of Ethics and Professional Conduct [incl. a link to Code of Ethics and Professional Conduct here]
  9. In the event that all or part of IGP or its business is transferred to a third party, you agree that any personal information IGP holds about you may be transferred to that entity or third party.
  10. You agree that by becoming an Associate, Member or Honorary Member, you automatically grant, and you represent and warrant that you have the right to grant, to IGP an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or part) and distribute your name, resume, CV, biography, and list of published works for any purpose, commerical, advertising, or otherwise, or in connection with the IGP Web site or the promotion thereof, to prepare derivative works of, or incorporate into other works, such as a listing on the IGP Web site of Honorary Fellows, and to grant and authorize sublicenses of the foregoing.
Use of Non-Member Personal Information

Personal information may be required of non-members for a variety of reasons such as:

  1. Process payments by you for products or services
  2. Carry out non-member administrative functions
  3. Send you membership and services news
  4. Respond to queries
Indemnity

IGP Associates, Members and users of the IGP Web site agree to save and hold harmless the Institute of Green Professionals, Inc., its Officers and Directors, any of its departments, agencies, independent contractors or employees, all of whom while working within their respective authority, from all claims, actions, causes of action, and losses, including reasonable attorney fees and court costs, arising out of or in any way related to any matter and/or endeavor undertaken by the Institute of Green Professionals, Inc., including, but not limited to the enforcement of the IGP Code of Ethics and Professional Conduct, User Content, any Third Party Applications, Software or Content you post or share on or through the IGP Web site, your use of the Service or the Web site, your conduct in connection with the Service or the Site or with other users of the Service or the Site, or any violation of this agreement or Terms and Conditions or of any law or the rights of any third party.

E-Mail Privacy

As an IGP member or web site visitor your e-mail address will only be used within IGP. We do not sell or rent e-mail addresses to anyone. If you wish to be removed from our e-mail mailings, please send an email to info@instituteofgreenprofessionals.org and in the address line indicate “Remove from e-mail list.”

Log Files and IP Addresses

As a visitor to the IGP web site we automatically log your IP address which is recognized by our web server. We use IP addresses to help us diagnose problems with our server, administer the Web site and collect broad demographic information for aggregate use.

Use of Cookies

In the process of viewing the IGP web site, your browser may store some small pieces of information (commonly known as “cookies”) on your computer’s hard drive. This information facilitates your use of our Site and helps us to provide the best level of service. Most Web browsers automatically accept cookies, and you can erase or block cookies from your computer if you want to, however, certain IGP services may not work if you set your browser not to accept cookies.

Non-Personal Information Collected

IGP automatically collects non-personal information about its Web site users such as the type of internet browsers you may use or the site from which you linked to our site. You cannot be personally identified from this information and it is only used to assist us in providing our users with an effective service from our Site. We may supply the owners or operators of third party sites from which it is possible to link to our Site with information relating to the number of users linking to our Site from their site(s).

IGP Disclosure of Your Information to Others

Other than the disclosures referred to on the IGP Web Site, IGP will not disclose any personal information without your permission unless we are legally required to do so (e.g., by Court order or for the purposes of prevention of fraud or other crime).

As part of the services offered to you through the IGP Site, the information you provide may be transferred to countries outside of the United States of America. For example if any of our servers are from time to time located in a country outside of the United States (e.g., European Economic Area or Canada) or one of our service providers is located in a country outside of the United States.

In addition, if you use IGP services while you are outside of the United States, your information may be transferred outside of the United States in order to provide you with those services.

Third Party Web Sites and Content

The IGP Web site contains links to other Web sites (“Third Party Sites”) as well as articles, text, graphics, designs, pictures, information, applications, software and other Content or items belonging to or originating from third parties (Third Party Applications, Software or Content). Such Third Party Sites and Third Party Applications, Software or Content are not investigated, checked for accuracy, or completeness by IGP, and we are not responsible for any Third Party Sites accessed through the IGP site or any Third Party Applications, Software or Content posted on, available through or installed from the IGP site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices or other policies of or contained in the Third Party Sites or the Third Party Applications, Software or Content. IGP’s inclusion of, linking to or permitting the use or installation of any Third Party Site or any Third Party Applications, Software or Content does not imply approval or endorsement thereof by IGP. If you decided to leave the IGP site and access the Third Party Sites or to use or install any Third Party Applications, Software or Content, you do so at your own risk and you should be aware that our terms and policies no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any site to which you navigate from the IGP site or relating to any applications you use or install from the site.

Submission of Content to IGP

By submitting Content to IGP, you automatically grant – or warrant that the owner of such Content has expressly granted – IGP the royalty-free, perpetual, irrevocable, non-exclusive and fully sub-licensable right and license to use, reproduce, modify, adapt, translate, publish and/or create derivative works from with attribution, distribute, perform, and display such Content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed.

IGP Web Site Advertising

The Institute of Green Professionals accepts various forms of advertisement on its web site, however, acceptance of an advertisement does not imply endorsement of the advertiser’s service(s) and/or product(s) by the Institute of Green Professionals. Links established from this site do not imply endorsement of the site’s product(s) and service(s) by the Institute of Green Professionals.

IGP’s Support Level to Web Site Users

It is a goal of IGP to provide 100 percent availability of its Internet site. Our Web site hosting corporation has implemented safeguards to prevent the loss of Internet connectivity, however, even with these safeguards in place, loss of connectivity or hardware failure can occur. It is for this reason that IGP cannot “guarantee” its Internet connectivity, nor can we be responsible for lost or delayed requests, email, or content.

Accuracy of IGP Records

It is our goal to maintain information about you that is as accurate as possible. Members and non-members may contact us at any time to review or change the details you have supplied to us at info@instituteofgreenprofessionals.org or members themselves can make changes in the Members-Only area of the IGP Web site.

Discussion Boards, Job Forum and Public Information

IGP may, from time to time, make chat rooms, forums, message boards, job forum/search and/or news available to its users. Any information that is disclosed in these areas becomes public information and you should always be careful when deciding to disclose your personal information. 

It is not the responsibility of IGP for maintaining the secrecy or any passwords you set up and/or any account information you have disclosed in these public forums.

Surveys

IGP may from time to time run online surveys. Our surveys may ask respondents for contact information (such as an email address) and demographic information (such as profession, age, zip code). We may also use contact data from our surveys to send the user information about IGP.

Security

The IGP site has security measures in place to protect the loss, misuse and alteration of the information under our control.

Prohibited Acts

Site users are asked not to post or transmit offensive or inaccurate material and to keep in mind that the Web pages of IGP may be viewed by children. Nonetheless, you understand that by using the IGP forums, profiles, or other services, it is possible that you may be exposed to Content that is offensive, inaccurate, indecent, or objectionable. Under no circumstances will IGP, its staff, or its service providers be held liable for any errors or omissions in any postings or Web pages, or for any loss or damages of any kind incurred as a result of the use of any information contained in IGP Web pages, profiles, email, or interactive forums.

When using IGP forums, profiles, or other IGP services, you agree not to do any of the following:

  1. Post or transmit any message, information, data, text, or other materials (“Content”) that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, pornographic, vulgar, obscene, infringing, inflammatory, fraudulent, libelous, that may be invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
  2. Post or transmit Content that involves ad hominem criticisms of any individual, or an effort to discourage others from a) enrolling in specific courses or programs, b) submitting work to specific scholarly journals, or c) funding specific research projects;
  3. Impersonate any person or entity, or falsely state or otherwise represent your identity or affiliation with another person or entity;
  4. Post or transmit any software, graphic files, or other Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as nondisclosure agreements);
  5. Post or transmit any unsolicited advertising, “junk mail,” “spam,” “chain letters,” investment or loan schemes, casino or gambling offers, or any other form of commercial solicitation;
  6. Harvest, collect, or solicit personal information, email addresses, passwords, or other contact information of other users from the IGP site by electronic or other means for purposes of sending unsolicited emails or unsolicited communications for commercial or unlawful purposes;
  7. Post religious content that is evangelical or missionary in nature, or is otherwise intended to proselytize readers on behalf of religion or a particular religion
  8. Use automated scripts to collect information from or otherwise interact with IGP;
  9. Intentionally or unintentionally violate any applicable local, state, national, or international law or any regulations having the force of law while using or accessing any of the IGP Web pages or services;
  10. Use IGP in any unlawful manner or in any other manner that could damage, disable, overburden or impair the site;
  11. Upload or transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party; and
  12. Resister for more than one Associate Account or Member Account, or register for an Associate Account or member Account on behalf of an individual other than yourself.
Children’s Privacy Guidelines

IGP is concerned about protecting the privacy of children and follows these guidelines:

IGP and its Web site do not knowingly collect online contact information of children without prior consent or parental notification, which will include an opportunity for the parent to prevent use of the information and participation in the activity. Without prior parental consent, online information will only be used to respond directly to the child’s request and will not be used for other purposes without prior parental consent.

IGP and its Web site do not knowingly collect personally identifiable contact information of children without prior parental consent.

IGP and its Web site do not knowingly distribute to third parties any personally identifiable information of children without prior parental consent.

IGP and its Web site do not knowingly give the ability to publicly post or otherwise distribute a child’s personally identifiable contact information without prior parental consent.

IGP and its Web site do not knowingly entice a child by the prospect of a special game, prize, contest or other activity, to divulge more information than is needed to participate in the activity.

Notices and Procedures for Making Claims of Copyright Infringement

Web pages, message boards, Forums, Profiles, and email messages sometimes contain material in which Users share material they have copied electronically from other sources. Because there are thousands of possible sources spread out across the Internet (e.g., newspapers, journals, Web sites), it is difficult for IGP to determine if anything posted within or transmitted through IGP content infringes on the copyright of another party.

IGP respects the intellectual property rights of others and, upon written notice thereof, will take action, as deemed appropriate in its sole discretion, to prevent User and Third-party Users from using the Website, and/or the Services in violation of the intellectual property rights of others.

Pursuant to the provisions of Section 512(c)(2) of the United States Copyright Act, 17 U.S.C. §101, et seq., notifications of claimed copyright infringement should be sent to IGP as follows:

Such notification of claimed copyright infringement must comply with the provisions of Section (c)(2)(3) of the United States Copyright Act and contain the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the material claimed to have been infringed, or if multiple copyrighted works at the Website are covered by a single notification, a representative list of such works at the Website;
  3. Identification of the material that is claimed to be infringing or to the the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficiwent to permit IGP to locate the material;
  4. Information reasonably sufficient to permit IGP to contact the party alleging infringement, such as an address, telephone number, and if available, an electronic mail address at which the party alleging infringement may be contacted;
  5. A statement that the party alleging infringement has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the party alleging infringement is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Reporting Violations of Terms and Conditions of Use

If you become aware of any violations of these Terms and Conditions of Use, please notify IGP at info@instituteofgreenprofessionals.org as soon as possible. IGP will review all information provided, however, cannot guarantee that action will be taken.

User Disputes

You are solely responsible for your interactions with other IGP users. We reserve the right, but have no obligation, to monitor disputes between you and another User(s).

Governance and Jurisdiction

These Terms and Conditions of Use shall be governed and construed in accordance with the laws of the State of Florida, excluding its conflict of law provisions. You and IGP agree to submit to the personal and exclusive jurisdiction of the courts located within the State of Florida, USA. The failure of IGP to exercise or enforce any right or provision of these Terms and Conditions of Use shall not constitute a waiver of such right or provision. In any provision of these Terms and Conditions of Use is found by a court of competent jurisdiction to be invalid, the court should endeavor to give effect to the intention reflected in the provision, and the other provisions in the Terms and Conditions of Use shall remain in full force and effect.

Timeliness of Any Claim or Cause of Action

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of IGP or these Terms and Conditions of Use must be filed within one (1) year after such claim or cause of action arises.

Section Titles

The section titles herein are for convenience only and have no legal or contractual effect.

Modification to Terms and Conditions of Use

IGP reserves the right to modify and change these Terms and Conditions of Use from time to time without notice to User. User is responsible for regularly reviewing these terms of use and IGP recommends that all Users review these Terms and Conditions of Use prior to any access or use of the Website, or any Services. A user’s continued use of the Website, or any services after the effective date of any changes or modifications thereto constitutes user’s acceptance of, and agreement, to such modifications and changes.

Definitions

In addition to the terms that are defined within the individual sections of these Terms and Conditions of Use, the following terms shall have the meanings ascribed thereto:

Content – All information, data, text, images, messages, sounds, graphics, and other materials (regardless of the format thereof which a) can be accessed, viewed, downloaded, or printed by the User at the Website or by using the Services; and b) which have been created by, or on behalf of, IGP, and have been posted, displayed, or otherwise made available at the Website to be viewed or accessed by user at the Website or by using the Services.
 
Forums (Discussion Forums) – A grouping of related threads of discussion among Users.
 
Profile – Information about a User’s Account that controls how the User views information in the Forums, including details about posted Content contributed by the User, personal information that the Account Owner wishes to share, (such as Web address or weblog address), as well as, settings that control how the User interacts with the Forums.
 
Service(s) – The term “Services” means any and all services, features, tools, applications and programs on the Website, or that can be accessed or utilized by the User using the Website. Membership Services include the member-only Neural Network and the ability to create Profiles and post messages to interactive Discussion Forums.
 
User – Any individual who visits or uses the IGP Website, whether or not he/she is an IGP Associate/Member.
 
User Account – An account that identifies the User and is associated with the User’s username and password, which are required for access to the Members Only sections of the Website.
 
User Content – Any documents, information, materials, and content uploaded, posted, e-mailed, transmitted, distributed, submitted or otherwise made available by User via the Website or utilizing the Services.
 
Website (Site) – The website located at the URL on which a link to these Terms and Conditions of Use is posted at the log-in or home page (or the web page from which the user accessed these Terms and Conditions of Use), together with all the web pages thereof.
 
IGP – IGP is an acronym for the Institute of Green Professionals, Inc. and for the “Institute of Green Professionals” website.
